General Terms and Conditions

1. Scope
The following General Terms and Conditions apply to all orders placed through my online shop. My online shop is intended exclusively for consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity. A business is a natural or legal person or a partnership with legal capacity that, when entering into a legal transaction, acts in the course of its commercial or independent professional activity.

2. Contractual Partner, Conclusion of the Contract, Correction Options
The purchase contract is concluded with Jochen Moenig.
By placing products in the online shop, I make a binding offer to conclude a contract for these products. You can initially place my products in your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction options provided and explained during the ordering process. The contract is concluded when you accept the offer for the goods contained in your shopping cart by clicking the order button. Immediately after submitting your order, you will receive an order confirmation by email.

3. Vertragssprache, Vertragstextspeicherung
The language(s) available for concluding the contract are: German
I store the contract text and send you the order details and my General Terms and Conditions in text form. You can also view the contract text through your customer account.

4. Delivery Conditions
In addition to the stated product prices, shipping costs will apply. Details regarding the amount of the shipping costs can be found with the respective product offers.

5. Payment
The following payment methods are generally available in my shop:
1. Credit card
2. PayPal
With this payment method, you will be redirected to the PayPal website. After completing the payment, you will be redirected to my website to complete the order.
3. Bank transfer
Please enter “Moenig-Shop”, your name and the item number as the payment reference. Your order will be shipped as soon as the payment has been received in my bank account.

6. Retention of Title
The goods remain my property until full payment has been received.

7. Transport Damage
If goods are delivered with obvious transport damage, please report such damage to the carrier as soon as possible and contact me immediately. Failure to make a complaint or contact me has no consequences for your statutory rights or their enforcement, in particular your statutory warranty rights. However, your cooperation helps me to assert my own claims against the carrier or the transport insurance.

8. Liability for Defects and Guarantees

Statutory liability for defects
Unless expressly agreed otherwise below, the statutory provisions governing liability for defects shall apply.
The following limitations and reductions of statutory periods do not apply to claims arising from damage caused by me, my legal representatives or persons employed in performing my contractual obligations:

• in the event of injury to life, body or health,
• in the event of an intentional or grossly negligent breach of duty, or fraudulent concealment,
• in the event of a breach of material contractual obligations, the fulfilment of which is essential for the proper performance of the contract and on compliance with which the contractual partner may ordinarily rely (cardinal obligations),
• within the scope of an applicable guarantee, where agreed, or
• insofar as the scope of the German Product Liability Act (Produkthaftungsgesetz) applies.

Limitations concerning consumers
For consumers purchasing used goods, the following applies: if a defect becomes apparent more than one year after delivery of the goods, claims relating to that defect are excluded. Defects that become apparent within one year of delivery of the goods may be asserted within the statutory limitation period of two years from delivery of the goods.

Guarantees and customer service
Information on any additional guarantees that may apply and their exact terms can be found with the respective product and on dedicated information pages in the online shop.

9. Liability
I shall always be liable without limitation for claims arising from damage caused by me, my legal representatives or persons employed in performing my contractual obligations:

• in the event of injury to life, body or health,
• in the event of an intentional or grossly negligent breach of duty,
• under guarantees, where agreed, or
• insofar as the scope of the German Product Liability Act (Produkthaftungsgesetz) applies.

In the event of a breach of material contractual obligations, the fulfilment of which is essential for the proper performance of the contract and on compliance with which the contractual partner may ordinarily rely (cardinal obligations), caused by slight negligence on my part or on the part of my legal representatives or persons employed in performing my contractual obligations, liability shall be limited in amount to the foreseeable damage that would typically be expected to occur at the time the contract was concluded.
In all other respects, claims for damages are excluded.

10. Dispute Resolution
am neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

Hand-Printed Works

For every print in the shop, I try to provide an extensive selection of images to give you a good impression of what the print actually looks like, particularly in terms of colour, textures and details. However, it is physically impossible to reproduce spot colours with 100% accuracy on a computer monitor.
Metallic colours and papers, glossy varnishes and Day-Glo colours cannot be reproduced particularly well on the internet and may look very different in person.
This is due to the nature of the RGB colour space, which is also the colour space used by your monitor.
It gets even more complicated: depending on the make, type and calibration of your monitor, graphics card, operating system, browser and other factors, a greenish-blue image may appear more bluish-green to you. I hope you understand the problem.

For orders shipped abroad, customs duties, taxes and other fees may apply that are not included in the total price. In rare cases, the customs authorities in your country may hold a shipment for a random inspection. If customs duties and taxes are charged on your order, they are payable upon delivery. Please contact your local customs authority for further information about the customs duties and taxes applicable in your country. I am not responsible for import taxes, customs duties or brokerage fees that may arise upon delivery of your international order.
If you refuse to pay taxes due upon delivery of your order, the package may be abandoned or destroyed, which would be a needless waste of trees, energy and resources. Under these circumstances, I cannot accept requests for a refund.

Please note: This English version of the General Terms and Conditions is provided for your convenience and to make the terms easier to understand. The legally binding version is the German version. In the event of any discrepancies, inconsistencies or differences in interpretation between the German and English versions, the German version shall prevail.
